Documentation environmental permit application

If you have a type 3 company, you need to apply for an environmental permit to  the Island Executive Council. If you have a type 4 company, you need to apply for an environmental permit to the Minister for Infrastructure and Water Management. You must provide documentation with the permit application.

Required documentation for environmental permit type 3

The application for an environmental permit type 3 must contain documention. The documentation should include:

  • name, address, telephone number and e-mail address
    If the person operating the establishment is not the person starting the business,  the email address of the person who operates the company should also be included.
  • address, cadastral data and location of the company
    This data is needed to determine the exact location of the company.
  • copy of the commercial register
  • nature, layout and operation of the business
    The nature of the business refers to what exactly the company’s main activity is, for example, metal shredding. Layout involves the provision of one or more floor plans that contain, for example, the boundaries of the site, the location and layout of the buildings and the destination of (work) spaces. Operation may include data on the specifications of the equipment and installations used in the company.
  • activities and processes that take place in the company and the techniques or installations required to do so.
    When submitting this data, it is important that the activities and processes are described in understandable language, so that this is easy for the competent authority and for local residents to understand. In addition, it is important that the activities and processes that are relevant to the environment are described. For example, storage tanks, installations and compressors.
  • required raw materials and intermediate and final products of the activities and processes
  • maximum operating capacity and rated output power or thermal inputs of the installations. 
    This data concerns specific parts or departments of a company that each have a different maximum capacity. The capacity of such part or department may sometimes depend on the maximum capacity of another department. For the assessment of the environmental permit application, it is important that the capacity of those parts is also indicated.
  • times, days and periods in which (parts of) the business are in operation
  • a situation sketch with a north arrow indicating the location of the company in relation to the surrounding area
  • detailed drawings of the installations and locations where emissions occur
  • nature and extent of the environmental impact that the company may cause
  • information on measures or facilities to prevent or limit the generation of waste, its recovery and the storage and disposal of waste
    Wastes are also wastes generated by cleaning and purification processes to prevent pollution of the environment. For example, cleaning by filters and oil and grease traps.
  • information on other measures taken to prevent or, where possible, reduce pollution and other adverse effects on the environment that the establishment may cause
  • information on the foreseeable developments of the company, which are relevant for the decision on the application of the environmental permit
    For example, new techniques or materials, which can further reduce or prevent the environmental impact.
  • indication and location of the largest containment system, the maximum amount of substance that may be present in it, an indication of the substance concerned and the pressure and temperature of the substances and preparations concerned in the containment system
    An containment system is also defined as: ‘a remotely blockable installation component containing hazardous substances. This can be a tank, but if there is no remotely controlled valve between tank and installation, the tank can be considered as a single containment system together with the installation.’ This definition is included in the IPO guide External safety in the environmental permit.
  • location of the pipelines of the establishment
  • an Environmental Impact Assessment (EIA) if applicable
  • all other information and which may be relevant for making a decision on the application
  • a non-technical summary of all data provided
    This means that the summary is understandable to the general public and contains sufficient information to be able to assess the application for a permit and the effects that the company might have on the environment.

The documentation for the application for environmental permit type 3 are set out in Article 3.2 of the Establishments and Activities Decree BES (IAB BES).

Data required for application for environmental permit type 4

If you have a type 4 company, you must provide the data for an environmental permit type 3 with the application. In addition, a number of additional information is required for the application:

  • carrying out a quantitative risk analysis (QRA) and providing its results.
    By carrying out a QRA, a statistical assessment of the risks to the environment  due to the hazardous activities can be made. It concerns, for example, the possible consequences of accidents caused by the storage, transport and processing of dangerous substances, such as toxic emissions, fires or explosions and air, water or soil pollution. Of the relevant risks, accident scenarios are elaborated. With the help of computer models, simulations are made for the theoretical development of a certain risk into an accident scenario. Subsequently, a risk analysis can be carried out.
  • written information on how the burden of the establishement on the environment is determined and recorded
  • a safety report, in the case of activity type 4, listed in Annex 1 of the IAB BES
  • information on unusual occurrences, such as disruptions in the production process, which could occur and understand the nature and extent of the unusual occurences and the measures taken to prevent or minimise the effects on the environment. Finally, the results of a survey on the quality of the soil at the location where the establishment is or will be located.
