Establishments- and activities Decree BES
The environmental rules for companies are set out in the Establishments- and activities Decree BES (IAB BES). The decree also lays down rules for inspection and enforcement and environmental impact assessment.
The IAB BES starts with rules that apply to all types of companies. These are, for example, the definitions of the decree, a description of the types of companies and the duty of care. The duty of care means that a company must not cause damage to the environment or prevent or limit it as much as possible.
Chapter 2 sets out rules for type 1 and type 2 companies. These are companies that carry out activities with little or limited impact on the environment. It is about the rules on notification and customised rules. With a customised rule, your company may deviate from the rules of the IAB BES in certain cases. Then a customised rule is devised. This can be imposed at your request or by the Executive Council.
The rules for an environmental permit and the application for an environmental permit are set out in chapter 3.
Chapter 4 deals with the environmental impact assessment (EIA). The EIA is an investigation into the possible effects on the environment through certain activities, plans or projects.
The quality requirements that inspection and enforcement organisations must comply with are set out in chapter 5. These are requirements for the preparation of an inspection and enforcement policy and an implementation programme.
Chapter 6 contains transitional law. Transitional law regulates until the old rules continue to apply and from when the new rules from the IAB BES will apply.
